Purchase Agreement

Introduction

Treasure Island and Cirque du Soleil would like to inform you that certain special events and Mystère may contain flashing lights which may cause difficulties for people with photosensitive epilepsy.  Please consider this factor when purchasing tickets.

This is a legal document that describes your rights and responsibilities as a user, including important information on the purchase of tickets.

When reference is made to this "Agreement", it shall include this Purchase Agreement, the Supplemental Terms, the Terms and Conditions, the Privacy Policy and the California Privacy Rights Policy (collectively, “Website Policies”), as applicable.  Treasure Island and/or Cirque du Soleil may modify the Website Policies in effect during your use of this website.  In case of discrepancy between this Purchase Agreement and the Website Policies, this Purchase Agreement shall prevail.

Tickets purchased through Treasure Island and/or Cirque du Soleil’s official website are tickets sold directly by Treasure Island or Cirque du Soleil to the Customer.  Such sale transactions are subject to and hereby incorporate the legally binding terms and conditions set out in the Agreement.

Tickets purchased through a third-party retailer are sold directly by such third-party retailer to the Customer.  For such transactions, only the terms of the Agreement which are not inconsistent with the third-party retailers’ purchase and website terms and conditions (if any) shall apply.

Conditions of Sale and Contractual Obligations

The parties to this Agreement are:

TREASURE ISLAND LLC at 3300 Las Vegas Blvd S, Las Vegas, NV 89109 in respect to special events, headliner comedians, etc. ("Treasure Island"), and/or

CIRQUE DU SOLEIL in respect of the presentation of the "Mystère" show presented at Treasure Island with Cirque du Soleil corporate headquarters at 1151 Grier Drive, Las Vegas, NV 89119 USA ("Cirque du Soleil");

- AND -

You (also referred to as the "Customer")

Conclusion of Contract and Order Confirmation

You hereby agree to purchase and Treasure Island and/or Cirque du Soleil agrees to sell the ticket(s) detailed in your order.  Once your order is confirmed and your payment completed, you will be redirected to a page indicating a confirmation number.  Please keep this number for your records. You will also receive an email confirming your order.

If you are not redirected to the confirmation page or do not receive a confirmation number, it is your responsibility to contact us at  ti-mystere@treasureisland.com or contact@cirquedusoleil.com to confirm whether your order was processed.

Should there be an error or an inaccuracy in the processing of the order or should a payment processor reject the transaction, a Treasure Island or Cirque du Soleil representative may attempt to contact you, using the information provided at the time of purchase.  If Treasure Island or Cirque du Soleil is unable to reach you after an initial attempt or if a payment processor rejects the transaction, Treasure Island or Cirque du Soleil reserves the right to cancel your order and sell the tickets to another customer.  In such case, you will be informed immediately, using the contact information you provided.

Service Fees and Facility Fees

You understand that tickets purchased through this website may be subject to a non-refundable per ticket or per order service fee and/or facility fee.

Delivery

In some circumstances, tickets purchased through this website can be delivered by regular mail, for an additional fee, at the address you provided during the check-out.  Otherwise, tickets will be delivered by e-mail at the e-mail address associated with your account, or at the venue’s box office before the show or event when such option is available.

If you choose to receive the tickets by e-mail, simply print your e-ticket(s) or present them at the show on a mobile device unless otherwise instructed.

Obligation to Pay

You agree to pay the full price of the tickets ordered, including any applicable taxes, service fees, facility fees, delivery fees and any other cost, as detailed in the purchase process.

No Refunds or Exchanges

Except as otherwise provided by this Agreement or any applicable law, the tickets you purchased cannot be refunded, exchanged or redeemable for cash. Carefully review your ticket selection before placing your order.

Cancelled and/or Postponed Shows or Events

Treasure Island and/or Cirque du Soleil may, at its sole discretion, cancel or postpone an event or show.  You will receive a written notice informing you of such cancellation or postponement.  When an event or show is cancelled or postponed, Treasure Island or Cirque du Soleil may either offer tickets for an event or performance at an alternate date or a refund.

Late Arrivals

The event or show starts on time.  Late arrivals are admitted only during a suitable break during the event or performance.

Right to Cancel Tickets, Refuse Access and Expel

Treasure Island and/or Cirque du Soleil reserves the right to cancel a ticket order purchased through its website(s).

Treasure Island and/or Cirque du Soleil reserves the right to request photo ID of the ticket holder(s).

In the event that any person attending an event or show is judged unmanageable or exhibits behavior which is considered inappropriate or fails to comply with Treasure Island and/or Cirque du Soleil policies, Treasure Island and/or Cirque du Soleil reserves the right to terminate such person's right to attend the event or show without any refund or compensation.

Recording, Transmission and Publication

All cameras, tape recorders and video recorders (including when incorporated in a mobile device) and their use are strictly forbidden during the performance of the show or event unless specified otherwise at the venue under limited circumstances.

You hereby grant Treasure Island and/or Cirque du Soleil the right to use your image, likeness, actions and statements in any transmission, publication or reproduction of the event and/or show, in any medium or context, without any further authorization or compensation.

Changes in the Show

Due to the nature of the acts in the event or show, Treasure Island and/or Cirque du Soleil may change, without any prior notice, the cast, content or duration of the event or show.

No Resale

Tickets may not be used for any advertising or promotional purposes (including contests or sweepstakes) or resold without the prior written authorization of Treasure Island and/or Cirque du Soleil.

Limitation of Liability

NOTWITHSTANDING ALL SECURITY MEASURES IN PLACE ON THE SITE, INJURY MAY OCCUR DURING THE EVENT OR SHOW. BY ACCEPTING THE TERMS OF THIS AGREEMENT, YOU AGREE TO ASSUME ALL RISKS, LIABILITIES AND RESPONSIBILITIES FOR ANY AND ALL DAMAGES OF ANY NATURE SUFFERED BY YOU, INCLUDING, WITHOUT LIMITATION, BODILY HARM AND LOSS OF PROPERTY INCURRED DURING OR IN CONNECTION WITH THE EVENT OR SHOW.  FURTHERMORE, YOU HEREBY WAIVE ANY AND ALL RIGHTS TO CLAIM DAMAGES OR TO INSTITUTE CIVIL, CRIMINAL, ADMINISTRATIVE OR LEGAL PROCEEDINGS AGAINST TREASURE ISLAND AND/OR CIRQUE DU SOLEIL, OR ANY OF ITS EMPLOYEES, DIRECTORS, OFFICERS, AFFILIATES OR OTHER RELATED ENTITIES, SPONSORS, VENDORS, REPRESENTATIVES, PARTNERS AND ALL OTHER PERSONS ACTING ON BEHALF OF TREASURE ISLAND AND/OR CIRQUE DU SOLEIL, RESULTING FROM ANY CAUSE WHATSOEVER ARISING EITHER BEFORE, DURING OR AFTER THE EVENT OR SHOW.

EXCEPT IN JURISDICTIONS WHERE SUCH PROVISIONS ARE RESTRICTED, UNDER NO CIRCUMSTANCES SHALL TREASURE ISLAND AND?OR CIRQUE DU SOLEIL OR ANY OF ITS EMPLOYEES, DIRECTORS, OFFICERS, AFFILIATES OR OTHER RELATED ENTITIES, SPONSORS, VENDORS, REPRESENTATIVES, PARTNERS AND ALL OTHER PERSONS ACTING ON BEHALF OF TREASURE ISLAND AND/OR CIRQUE DU SOLEIL, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE PURCHASE OF ANY TICKETS OR ATTENDANCE TO THE EVENT OR SHOW, EVEN IF TREASURE ISLAND AND/OR CIRQUE DU SOLEIL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ALL CLAIMS OR CAUSES OF ACTION ARISING FROM OR RELATED TO YOUR PURCHASE OF TICKETS MUST BE FILED WITHIN ONE (1) YEAR FOLLOWING THE DATE ON WHICH SUCH CLAIM OR CAUSE OF ACTION FIRST AROSE.

YOU AGREE THAT THE MAXIMUM AVAILABLE REMEDY ON ANY SUCCESSFUL CLAIM SHALL NOT EXCEED THE PURCHASE PRICE OF THE TICKETS DETAILED IN THE ORDER CONFIRMATION.

Assignment

Treasure Island and/or Cirque du Soleil may at any time assign all or part of its rights and obligations under this Agreement, to any of its affiliated entities, regardless of whether the entity is controlled by, controlling or under the same control as Treasure Island and/or Cirque du Soleil, provided that the assignee assumes all of Treasure Island and/or Cirque du Soleil’s obligations hereunder.

Invalidity

If any term, provision or section of this Agreement or any portion of such term, provision or section is held invalid or unenforceable, the remainder of this Agreement will not be affected thereby and each remaining term, provision or section, or portion thereof, will be valid and enforceable to the full extent permitted by law.  In lieu of each term, provision or section of this Agreement that is held invalid or unenforceable, there shall be added as a part of this Agreement a term, provision or section as nearly identical as may be possible and as may be legal, valid and enforceable.

Alternative Dispute Resolution

In the event of a dispute between Treasure Island and/or Cirque du Soleil and yourself, there are a range of options for resolving such dispute without going to court.  We invite you to contact us at: ti-mystere@treasureisland.com or contact@cirquedusoleil.com.

Applicable Laws

This Agreement is governed by the laws of Clark County in the State of Nevada, USA (including applicable USA laws).

Additional Terms for Official Venue of the Las Vegas Strip Circuit Event

• Seat allocations are subject to change.
• Illegible tickets shall be void.
• For security measures, you may be refused admission and/or be removed from the Official Venue, searched by officials, and/or filmed by CCTV.
• Animals/articles that compromise public safety are not permitted.
• You must not make/create/store/record/transmit any kind of sound recording/visual footage/audio-visual footage/information/other data.
• Equipment that may enable you to do the aforementioned acts is not permitted.
• Personal electronic devices including still image cameras/mobile telephones/other handheld personal communications devices are permitted provided that any images/films/recordings/data that are created/recorded/stored thereon are used for personal/ private/non-commercial use only.
• On request, you shall assign in writing copyright/all other intellectual property rights in any images/films/recordings you create/record at the event to Formula One World Championship Limited (FOWC) and agree that such images/films/recordings shall not be used for public advertisement/commercial gain/any other purpose (except private enjoyment) without FOWC’s prior written consent.
• Motor racing is dangerous and noisy.  Sanctioning bodies, FIA, FOWC, Formula One Management Limited, Formula One Licensing B.V., Formula One Asset Management Limited, Formula One Hospitality and Event Services Limited, Formula One Marketing Limited, organizers of the Event (including officials, marshals, rescue, medical staff), competitors and drivers, the Official Venue and Treasure Island are not responsible for any loss or damage, howsoever caused, to you to the maximum extent permitted by the applicable USA laws (except in the case negligence of the above parties).
• You must always keep to the designated paths and steps.
• You must comply with all instructions given by any Event and/or Official Venue official.
• No person may use the name of the Event or part thereof (nor any abbreviation or foreign language version thereof) nor any logo or graphic device of or relating to the Event for any commercial purpose without the prior written consent of FOWC.
